Job applicant privacy notice

Dredging, Environmental & Marine Engineering NV/SA (“DEME”, “we”, “us”, “our”) have to process* personal data about you in connection with your application for a job. DEME values your trust and is committed to the responsible management and protection of personal information. This Job Applicant Privacy Notice (Notice) is to inform the Applicant (“you”) about what we collect from you during and after the recruitment process.

(*“Processing” meaning: all possible operations on data, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure, combination, restriction, erasure or destruction)

What categories of personal data does DEME collect about you

We will collect the following categories and types of personal data:

  • Identification data, such as first and last name and contact information
  • General personal data, such as date and place of birth and gender
  • Data about Education and training, such as overview of visited schools, skills, certificates
  • Data about Occupation and employment, such as employment history, current and desired salary

You provide this data to DEME through:

  • The application form on the DEME website
  • The application data in your CV and cover letter
  • Information collected as part of the interview process, such as notes taken from your interview and/or assessment

Why do we process your personal data

Processing data from you allows us:

  • To manage the recruitment process
  • To assess your capabilities and qualifications for a job
  • To respond to your inquiries and communicate with you about your application
  • To process a job offer should you be successful

Legal grounds

We process the personal data based on one of the following legitimate grounds:

  • The processing is necessary for compliance with our legal obligations
  • The processing is necessary for the purposes of our legitimate interests
  • The processing is necessary for the performance of a contract to which you are party or in order to take steps at your requests prior to entering into a contract
  • You have given your consent for the processing

Data recipients

DEME can share your data within the entities of the Group for the purposes of the recruitment exercise. This includes members of the HR and recruitment team, interviewers involved in the recruitment process, managers in the business area with a vacancy. Your personal data may also be processed by third parties who work for DEME.

Transfer of information

Personal data provided to us may be transferred to, or stored by, or disclosed to an overseas recipient. For example we may use a server hosted overseas to store your personal data. We will take reasonable steps as appropriate under the circumstances before your personal data is disclosed to an overseas recipient, to ensure that the standard of protection to personal data so transferred is comparable to the level of protection that the company currently has in place.

Security

Protecting your privacy and your information is a priority at DEME. DEME uses a variety of security technologies and procedures to help protect your personal data from accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access.

Time limitation

If your application for employment is unsuccessful, the organisation will hold your data on file for 3 calendar years after the year of the relevant recruitment process. At the end of that period, or once you withdraw your consent, your data is deleted or destroyed.

If your application for employment is successful, personal data gathered during the recruitment process will be transferred to your Human Resources file (electronic and paper based) and retained during your employment. 

Your rights

In accordance with and subject to the conditions provided by applicable data protection law, you are entitled to request from DEME:

  • Access to and rectification or erasure of the personal data
  • To receive the personal data gathered by DEME in a structured, commonly used and machine-readable format

If you want to exercise these rights, DEME will respond to this request within one (1) month after the receipt thereof. This request has to be admitted by registered post or by email to dataprotectionofficer@deme-group.com

If the processing of personal data has been based upon your consent, you have the right to withdraw your consent at any time, without prejudice to the legitimacy of the processing based on this consent prior to its withdrawing.

You are also entitled to lodge a complaint with the competent supervisory authority, i.e. the Belgian Data Protection Authority (DPA) (https://www.dataprotectionauthority.be).
